1. Who We Are and What These Terms Cover
These Terms of Service (“Terms”) govern your access to and use of the EQORE website located at eqore.net (the “Site”). The Site is operated by EQORE Inc., a Delaware corporation (“EQORE,” “we,” “us,” or “our”), with a mailing address at 444 Somerville Avenue, Somerville, MA 02143. These Terms are a legally binding agreement between you and EQORE. By using the Site, you accept and agree to these Terms. If you do not agree, do not use the Site.
2. Who May Use the Site
The Site is intended for individuals who are 18 years of age or older. By using the Site, you represent that you are at least 18. If you are under 18, do not use the Site.

The Site is a public, informational website. You can:

The Site may include links to third-party websites, including a Coda-hosted Careers page with a job application form. We do not offer user accounts, a customer portal, e-commerce, payments, user-generated content features, or software downloads through the Site.

We may provide links to third-party sites and services, such as Coda for our Careers page and job application form. Those third-party sites and services are governed by their own terms and privacy policies, not these Terms. We do not control and are not responsible for third-party sites, services, or content. Your use of third-party sites is at your own risk.
5. Privacy
When you interact with the Site, including by submitting a “Contact Us” form or subscribing to our newsletter, we may collect and use information about you. Our handling of personal information is described in our Privacy Policy (if and when published on the Site). For third-party features and pages (including the Coda-hosted Careers page and application form), the relevant third party’s privacy policy applies. You may use the Site only for lawful, personal, and informational purposes. You agree not to:

7. Content and Ownership

All rights not expressly granted are reserved.

The Site and its content are provided for general informational purposes only. We do not offer professional, legal, financial, medical, or other advice through the Site. Do not rely on the Site as a substitute for professional advice. Any decisions you make based on information on the Site are made at your own risk.
9. No Warranties
To the fullest extent permitted by law, the Site and all content are provided “as is” and “as available,” without warranties of any kind, express or implied. EQORE and our suppliers and licensors disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Site or the servers that make it available are free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or timeliness of any content.
10. Limitation of Liability
To the fullest extent permitted by law:

EQORE and our officers, directors, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages; loss of profits, revenues, goodwill, data, or use; or business interruption, even if we have been advised of the possibility of such damages.

The total aggregate liability of EQORE and our officers, directors, employees, agents, suppliers, and licensors for all claims arising out of or related to your use of the Site will not exceed fifty U.S. dollars (US $50).
Some jurisdictions do not allow certain limitations or exclusions of liability; in those jurisdictions, our liability will be limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless EQORE and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
12. Changes to the Site and These Terms
We may update, modify, or discontinue the Site (in whole or in part) at any time without notice. We may also update these Terms from time to time. If we make material changes, we may post a notice on the Site or otherwise communicate the change. The “Last Updated” date above will reflect the latest version. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
13. Suspension or Termination
We may suspend or terminate your access to the Site at any time and for any reason, including if we believe you have violated these Terms or applicable law. Upon termination, the rights granted to you under these Terms will end immediately.
14. Governing Law; Jurisdiction; Venue
These Terms and any dispute or claim arising out of or relating to them or the Site are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules. You and EQORE agree to the exclusive jurisdiction and venue of the state and federal courts located in Boston, Massachusetts, and waive any objection to such jurisdiction and venue, including forum non conveniens.
15. Arbitration; Class Action Waiver
To the fullest extent permitted by law, you and EQORE agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved on an individual basis, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. Class actions and class arbitrations are not permitted.
If a court of competent jurisdiction finds the class action waiver in this Section unenforceable, the entire Section 15 will be null and void. Nothing in this Section prohibits you or EQORE from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to protect confidential information or intellectual property.
16. Export and Sanctions Compliance
You agree to comply with all applicable U.S. and international export control and economic sanctions laws and regulations in connection with your use of the Site. You may not use or access the Site if you are located in a jurisdiction subject to comprehensive U.S. sanctions or are on a U.S. government restricted party list.
17. Severability; Waiver; Assignment
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms without restriction.
18. Entire Agreement
These Terms constitute the entire agreement between you and EQORE regarding the Site and supersede any prior or contemporaneous understandings or agreements on the subject matter. These Terms do not create any third-party beneficiary rights.
